Andy Tindel is the managing attorney of the Tyler, Texas office of the Provost*Umphrey Law Firm, L.L.P. $285,000,000 SETTLEMENT OF EL PASO SECURITIES FRAUD LITIGATION APPROVED

On March 9, 2007, the Honorable Lynn Hughes, United States District Judge for the Southern District of Texas, approved the settlement of certain consolidated securities fraud claims proceeding under the style of Oscar S. Wyatt, Jr. v. El Paso Corporation, et al., pending in the United States District Court for the Southern Distict of Texas. The terms of the settlement approved by the Court requires El Paso and the accounting firm of Price Waterhouse Coopers to pay a combined total of $285,000,00, less an attorney's fee of $43,558,317, to El Paso shareholders based upon a plan of allocation approved by the Court at a fairness hearing conducted on March 3, 2007 in Houston.  In approving the award of attorney's fees, Judge Hughes found that class counsel obtained a highly favorable settlement for El Paso shareholders through extensive time, work and thought by class counsel.  ANDY TINDEL managing attorney of the Tyler, Texas office of the Provost * Umphrey Law Firm, L.L.P. served as counsel for Lead Plaintiff Oscar Wyatt and the class.  

$4,150,000 SETTLEMENT REACHED FOR INJURED OILFIELD WORKER

On January 19, 2007 the United States District Court for the Eastern District of Texas entered a judgment in favor of an injured East Texas employee of Cactus Drilling Company against an out of state oilfield service company.  The employee was catastrophically injured when a "suitcase" cable tray attached to a slingshot drilling rig owned by Cactus Drilling folded over on top of the injured worker.  The settlement terms provide for compensation on the basis of a combined cash payment and structured annuity that will provide for the injured worker's medical and rehabilitative care needs for the remainder of his life.  The plaintiffs in this case were represented by ANDY TINDEL of the Tyler office of Provost Umphrey.

HOLLYWOOD PREMIERE OF RAZORSHARP SET FOR JANUARY 10

The action feature RAZORSHARP, written and directed by Marcus Perry, will premiere at the Fine Arts Theater on Wilshire Blvd. in Beverly Hills the evening of Janauary 10.  RAZORSHARP, which was co-produced by Andy Tindel, features Cassady Freeman in the title role of Veronica Sharpe, along with the noted character actor, Michael T. TYLER FEDERAL JURY RETURNS INSURANCE CODE VERDICT FOR ETMC

TYLER - On September 15, 2006, after a week long trial presided over by United States District Judge Michael H. Schneider, a Tyler federal jury decided that AIG/Lexington Insurance Company knowingly violated the Texas Insurance Code in denying an insurance claim presented by East Texas Medical Center Regional Healthcare System.  The jury's award will result in ETMC recovering over $2,000,000 in actual and punitive damages and attorney's fees. The jury also rejected a counterclaim filed by AIG alleging that ETMC owed it in excess of  $2,500,000. 

ETMC was represented by ANDY TINDEL, managing partner of the Tyler, Texas office of the Provost * Umphrey Law Firm.  After return of the verdict, Tindel stated "I am proud that the jury realized that this insurance company wrongfully denied a claim submitted by ETMC.  I hope this verdict will send a message to AIG that the people of East Texas will not stand for insurance companies taking premium dollars from its insureds and then refusing to pay valid claims."    

TINDEL NAMED A  TEXAS "SUPER LAWYER" FOR 2007

Andy Tindel has again been recognized as a Super Lawyer by Texas Monthly magazine.  Tindel was initially named a Texas Super Lawyer in 2003, the first year the designation was created, and has been recognized as a Texas Super Lawyer every year thereafter. Super Lawyers selections are based on peer nominations made by more than 70,000 attorneys across Texas. A panel of lawyers selected by Super Lawyers editors made the final selections, and less than 5 percent of the attorneys in Texas were chosen for this honor.

U.S.  DISTRICT JUDGE WILLIAM STEGER EULOGY DELIVERED BY ANDY TINDEL

At the memorial service for Eastern District of Texas Senior United States District Judge William M. Following Judge Steger's death, the United States Congress passed a law naming the federal courthouse complex in Tyler, Texas as the "William M. Steger United States Courthouse".
